Data Protection Compliance

Many of our clients utilise and store a significant amount of client data. As a result of the stringent Data Protection Regulations and associated penalties, Wavex have negotiated a special rate for Wavex clients with a well know law firm who will carry out a formal Data Protection Act compliance review. Given the variation in data storage between companies, our partner law firm will advise you separately of the price and work involved.

Given the penalties and increasing checks, Wavex would like to strongly recommend that our clients consider this requirement.

Introduction

The Data Protection Act 1984 was introduced to safeguard personal information concerning any living individual that is held on a computer or computer generated output (e.g. floppy disk or printout). All companies have had to become far more aware of the physical security of information which is stored and processed by computers. Wavex is no exception.

The Data Protection Act requires that systems which hold any information of a personal nature must register the following details:

  • The purpose for which the information is held.
  • The type of information held.
  • Where the information was obtained from.
  • Who the information is given to.

Additionally it is a requirement of any system registered under the provisions of the Data Protection Act that all information should be both up to date and accurate.

When the Act Applies

The provisions of the Act apply to all items of information which are defined as 'personal', which broadly speaking means data about an identifiable living person (or a private company registered in an individual's name) that is processed automatically, whether by main frame, servers or PCs. It also applies to specially-prepared input documents such as system input forms.

Registration Criteria

Where an application which includes details of a personal nature is developed, or an existing system is amended to contain such details, then this function must be registered. If you have any doubts regarding the need to register under the Act, you should contact the Wavex Data Protection Officer for advice (0181 722 2324). The Data Protection Officer maintains one central register for all group companies, and is responsible for registering new uses of personal data and amendments to existing details as appropriate.

Subject Access

Provision is made within the Act for Subject Access. This means that if any person (whether an employee, customer or otherwise) thinks that Wavex holds data on him or her, then in return for a search fee, the company is obliged to identify and supply copies of any data held at the time of the request, in respect of that person. All responses must be provided within 30 days of request. The Data Protection Officer co-ordinates all responses and must therefore be notified immediately requests are received.
